These Terms and Conditions ("Terms") form a binding agreement between you and TruckFestMap ("we," "our," or "us"). They govern your access to and use of the TruckFestMap mobile application for iOS and Android, the website and business dashboard at truckfestmap.com and app.truckfestmap.com, and all related features and services (together, the "Service").
By creating an account, accessing, or using the Service, you confirm that you accept these Terms and our Privacy Policy (incorporated by reference). If you do not agree, do not use the Service.
TruckFestMap is a discovery and listing platform that allows users to browse and search food trucks by cuisine, location, and other criteria; view profiles, menus, photos, ratings, and locations on a map; save favourites and leave reviews and ratings; submit catering/event inquiries to matching food-truck owners; (for Food-Truck Owners) create and manage truck profiles, menus, photos, live location, and rental availability, and respond to inquiries; and (for Event Organisers) create and manage events.
TruckFestMap is an intermediary platform. We do not own, operate, prepare, sell, or deliver food, and we are not a party to any agreement, booking, or transaction between users. We do not guarantee the accuracy of listings, the quality or safety of food, or that any inquiry will result in a booking.
You must be at least 16 years old (or the age of digital consent in your country) to create an account. By using the Service you represent that you meet this requirement and that the information you provide is accurate. Business accounts must be operated by a person authorised to act on behalf of the relevant business.
You can register using email and password, or by signing in with Google or Apple. You agree to provide accurate, current, and complete information and to keep it updated. Consumer accounts are free; Food-Truck Owner and Event Organiser roles are granted by invitation issued by an administrator, and we may verify business identity and details.
You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately at support@truckfestmap.com of any unauthorised use.
Use of the Service as a consumer (browsing, favourites, reviews, inquiries) is currently free.
Certain business features — including the ability to create and publish food trucks and access features such as rentals, messaging, and priority placement — require a paid Subscription. Subscriptions are offered in Basic and Premium tiers, each available on monthly, 6-month, and annual billing cycles. The available plans, prices, features, and limits are shown at the point of purchase.
Payments are processed by Stripe. By subscribing, you authorise us (through Stripe) to charge the applicable fees, including taxes, to your payment method. We do not store your full card details. Your use of Stripe is also subject to Stripe’s terms and privacy policy.
Subscriptions renew automatically at the end of each billing cycle at the then-current price, unless you cancel before the renewal date. You can cancel or manage your subscription through the dashboard or the customer portal. When you cancel, your Subscription remains active until the end of the current paid period, after which it will not renew.
If you are an EU consumer, you may have a statutory 14-day right of withdrawal for distance contracts. Where you request that a paid digital service begin immediately, you may be asked to acknowledge that you lose the right of withdrawal once the service has been fully performed, or to pay for the portion provided. Except where required by law, fees already paid are non-refundable. Nothing in these Terms limits mandatory consumer rights.
We may change subscription prices or plan features. We will give reasonable advance notice, and changes apply from your next billing cycle.
You retain ownership of your User Content. By submitting User Content, you grant TruckFestMap a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt (for formatting/resizing), publish, and display that Content for the purpose of operating, promoting, and improving the Service. This licence ends when you delete the Content or your account, except for copies retained for legal or backup purposes for a limited period and Content others have already shared.
You represent that you own or have the necessary rights to your User Content and that it does not infringe any third-party rights or violate any law. You are solely responsible for your User Content.
Reviews must reflect genuine experiences. You may not post fake, incentivised, defamatory, or misleading reviews, or reviews of your own business or competitors. We may remove reviews that violate these Terms.
You agree not to: post false, misleading, fraudulent, infringing, offensive, hateful, or unlawful content; impersonate others; harass, threaten, or abuse other users; upload content depicting or promoting violence, sexual content, or illegal activity; collect other users’ data, or use contact details obtained through inquiries for any purpose other than responding to that inquiry or for unlawful marketing/spam; attempt to gain unauthorised access to the Service or other accounts; use bots or scrapers except as permitted; interfere with or disrupt the Service; use the Service to compete with us by extracting our data; or reverse engineer or attempt to extract source code, except as permitted by mandatory law.
Food-Truck Owners must provide accurate business, menu, pricing, and location information; hold and maintain all required licences, permits, and health/safety/hygiene certifications; comply with all applicable food-safety, consumer, tax, and business regulations; honour the offers and information they publish; and respond to inquiries honestly. Owners are solely responsible for the food and services they provide.
Event Organisers must provide accurate event information; obtain all necessary permits and authorisations; ensure events are safe and lawful; and honour arrangements made with food-truck owners.
Business users are independent operators. Nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship between you and TruckFestMap.
The inquiry feature lets consumers send catering/event requests, including their contact details, to matching food-truck owners. Any resulting communication, agreement, booking, payment, or service is solely between the users involved. TruckFestMap is not a party to and is not responsible for such arrangements, including pricing, performance, cancellations, food quality, or disputes. Food-truck owners must use received contact details only to respond to the relevant inquiry and in compliance with data-protection law.
The Service uses device location (with your permission) to show food trucks near you. Food-Truck Owners may enable "live location" to publish their truck’s current position to users; this can be turned off at any time. The App does not track consumer location in the background. You can control location permissions through your device settings; disabling them may limit certain features.
The Service integrates third-party services, including Supabase, Cloudflare Images, Stripe, Google Maps, Google and Apple sign-in, Expo push notifications, and Resend (email). Your use of these features may be subject to those providers’ own terms and privacy policies. We are not responsible for third-party services, their availability, or their content.
The Service — including its software, design, text, graphics, logos, and the "TruckFestMap" name and branding — is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for its intended purpose, subject to these Terms. You may not copy, modify, distribute, sell, or create derivative works from the Service except as expressly permitted.
We may, but are not obligated to, review, moderate, or remove Content. We may remove or disable access to Content, restrict features, or suspend or terminate accounts that violate these Terms or applicable law, or that we reasonably believe may harm users, third parties, or TruckFestMap. Where required by applicable law (including the EU Digital Services Act), we will provide affected users with a statement of reasons and information about how to contest such decisions.
If you believe Content infringes your rights, contact legal@truckfestmap.com with a description of the work, the allegedly infringing Content and its location, your contact details, and a statement of good-faith belief that the use is unauthorised.
To the maximum extent permitted by law, the Service is provided "as is" and "as available." We do not warrant that the Service will be uninterrupted, error-free, secure, or available in all locations or on all devices, or that Content (including listings, menus, prices, locations, and reviews) is accurate, complete, or reliable. We are not responsible for food safety, food quality, hygiene, allergens, or any health consequences arising from food or services provided by food-truck owners. You rely on Content and deal with other users at your own risk. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including mandatory consumer-protection rights.
To the maximum extent permitted by law, TruckFestMap is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business. Our total aggregate liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to liability, or EUR 100. These limits do not apply to liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under applicable law. If you are a consumer, these limitations do not affect your statutory rights.
If you are a business user, you agree to indemnify and hold harmless TruckFestMap and its officers, employees, and agents from claims, damages, losses, and reasonable expenses (including legal fees) arising from your use of the Service, your Content, your products or services, or your breach of these Terms or of any law or third-party right.
You may stop using the Service and delete your account at any time using the account-deletion feature. Deletion removes your profile and associated content as described in the Privacy Policy, subject to legal-retention requirements. We may suspend or terminate your access, with or without notice, if you breach these Terms or applicable law, create risk or legal exposure for us, or for prolonged inactivity or discontinuation of the Service. On termination, your right to use the Service ends, and provisions that by their nature should survive will survive. Paid amounts are non-refundable except as required by law or stated in Section 4.
We may modify or discontinue features of the Service. We may also update these Terms; when changes are material, we will provide reasonable notice (for example, in-app, on the Website, or by email) and, where required, obtain your consent. Changes take effect when posted with an updated date, and your continued use constitutes acceptance. If you do not agree, you must stop using the Service.
These Terms are governed by the laws of the Republic of Lithuania, without regard to conflict-of-law rules, and subject to the mandatory consumer-protection laws of your country of residence if you are a consumer in the EU.
Please first contact support@truckfestmap.com; we will try to resolve disputes informally. EU consumers may bring proceedings in the courts of their country of residence and may also use the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr, and in Lithuania the State Consumer Rights Protection Authority.
When you download the App from the Apple App Store ("Apple"): these Terms are between you and TruckFestMap only, not with Apple, and Apple is not responsible for the App or its content; your licence is limited to use on Apple-branded products you own or control, as permitted by the App Store Terms of Service; Apple has no obligation to provide maintenance or support; to the extent permitted by law, Apple is not responsible for product warranties, and any warranty claim is TruckFestMap’s responsibility, subject to these Terms and applicable law; Apple is not responsible for addressing claims relating to the App, including product-liability, regulatory, consumer-protection, or intellectual-property claims; you represent that you are not located in a country subject to a U.S. Government embargo or on any U.S. Government prohibited/restricted-party list; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
When you download the App from Google Play, your use is also subject to the Google Play Terms of Service. These Terms govern your relationship with TruckFestMap, not with Google.
These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for failures caused by events beyond our reasonable control.
